These Terms of Use (“Terms”) govern your access to and use of the QuickSiteReport application, website, cloud functionality and related services (collectively, “QuickSiteReport”, the “App”, the “Service”, “we”, “us” or “our”).

QuickSiteReport is operated by Vasilis Polykarpou, Cyprus.

By downloading, accessing, registering for or using QuickSiteReport, you agree to these Terms. If you do not agree with these Terms, you should not use the Service.

These Terms should be read together with the QuickSiteReport Privacy Policy.

1. About QuickSiteReport

QuickSiteReport is a professional construction documentation and productivity tool intended primarily for engineers, contractors, site supervisors and other construction professionals.

The Service enables users to create, store, organize, search, synchronize and generate construction-related records and professional reports containing information such as project details, work activities, personnel, equipment, materials, weather and site conditions, photographs, observations, notes, signatures and other project information.

QuickSiteReport follows an offline-first design for applicable functionality.

Certain account, cloud, synchronization, subscription or other functionality may depend on the version, platform and plan being used.

2. Eligibility

QuickSiteReport is intended for persons aged 18 years or older.

By using QuickSiteReport, you confirm that you have the legal capacity to agree to these Terms.

If you use QuickSiteReport on behalf of a company, organization or other legal entity, you confirm that you have authority to do so.

3. Accounts

Some QuickSiteReport functionality may be available without creating an account.

Cloud, synchronization, subscription and other account-based features may require registration and authentication.

You are responsible for:

  • providing reasonably accurate account information;

  • protecting your account credentials;

  • maintaining appropriate security on devices from which your account is accessed; and

  • promptly taking reasonable action if you believe your account has been compromised.

You must not intentionally provide unauthorized access to your account.

4. Free and PRO Services

QuickSiteReport may provide Free and paid PRO functionality.

Features, usage limits and benefits associated with each plan may evolve as QuickSiteReport develops.

Any material price, billing period or subscription information applicable to a purchase will be presented before the user completes that purchase.

We may add, modify or discontinue functionality where reasonably necessary for technical, security, legal, platform, product or business reasons, subject to applicable law and the rights of users with active paid services.

5. Subscriptions and Billing

PRO functionality may be offered through recurring subscriptions.

Depending on platform availability, subscriptions may be offered through:

  • Google Play;

  • the Apple App Store, when QuickSiteReport becomes available on iOS;

  • another applicable app store, distribution platform or payment provider through which QuickSiteReport is offered.

The applicable price, currency, billing period, taxes and other material purchase information will be presented before purchase.

Payment information is normally processed by the applicable store or payment provider. QuickSiteReport does not need to receive or store full payment-card details where payment is handled entirely by that provider.

Purchases may also be subject to the applicable store's own terms and policies.

6. Automatic Renewal

Where a subscription is offered on an auto-renewing basis, it will continue for successive billing periods until cancelled in accordance with the rules of the applicable platform.

Billing frequency and renewal conditions will be shown before purchase.

Users are responsible for managing their subscriptions through the applicable store or other subscription-management method made available to them.

7. Subscription Price Changes

Subscription prices may change from time to time for legitimate reasons, including changes in:

  • functionality or service offering;

  • operational or infrastructure costs;

  • taxes or regulatory requirements;

  • currency or market conditions;

  • app-store requirements; or

  • other reasonable commercial circumstances.

A newly advertised price does not necessarily apply immediately to an existing subscriber.

Any change affecting an existing subscription will be handled in accordance with applicable law and the requirements of the platform through which the subscription was purchased.

Where advance notice, consent or an opportunity to cancel is required, the applicable process will be followed.

For Google Play subscriptions, existing subscribers may remain in legacy price cohorts until they are migrated according to Google's applicable subscription-price rules.

8. Cancellation

Users may cancel an auto-renewing subscription using the subscription-management method provided by the platform through which it was purchased.

Uninstalling QuickSiteReport does not by itself cancel an active subscription.

Unless applicable law or the platform's rules provide otherwise, cancellation prevents future renewal while paid access normally remains available until the end of the period already paid for.

Deleting a QuickSiteReport account and cancelling an app-store subscription are separate actions.

9. Refunds

Except where required by applicable law or mandatory rules of the platform through which a purchase was made, payments for subscriptions and digital services are non-refundable.

Refund requests and eligibility are handled in accordance with applicable law and the refund rules of the relevant store or payment provider.

QuickSiteReport does not voluntarily guarantee refunds outside those rights and requirements.

Nothing in these Terms removes any refund, withdrawal, conformity or other consumer right that cannot legally be excluded.

10. License to Use QuickSiteReport

Subject to these Terms, QuickSiteReport grants you a limited, non-exclusive, non-transferable and revocable right to install and use the Service for its intended purposes.

You do not acquire ownership of the QuickSiteReport software, branding or underlying intellectual property.

Except where applicable law expressly permits otherwise, you must not:

  • reproduce or redistribute QuickSiteReport as your own product;

  • sell or sublicense the QuickSiteReport software;

  • circumvent subscription, entitlement or security mechanisms;

  • attempt unauthorized access to QuickSiteReport infrastructure;

  • maliciously reverse engineer or interfere with the Service; or

  • exploit QuickSiteReport in an unauthorized manner.

These restrictions do not prevent you from using, exporting or sharing your own reports and User Content where you have the right to do so.

11. User Content

You retain your rights in information and content that you lawfully create, enter or upload through QuickSiteReport, including project information, photographs, notes, signatures and construction records (“User Content”).

QuickSiteReport does not acquire ownership of User Content merely because the Service stores, processes, backs up, synchronizes or displays it.

You grant QuickSiteReport only the rights reasonably necessary to host, store, transmit, synchronize, process, back up and otherwise handle User Content for the purpose of providing, maintaining and securing the Service.

12. Information About Other People

User Content may contain information relating to workers, engineers, subcontractors, visitors, clients or other persons.

You are responsible for determining whether you have the appropriate lawful basis, permission, authorization or other right required to collect and process that information.

This responsibility may include photographs, names, signatures and other personal information entered through QuickSiteReport.

QuickSiteReport does not independently verify whether every user has obtained every permission required for their User Content.

13. Photographs, Logos and Signatures

Users must have the necessary rights or authority to upload, capture or use photographs, company logos, signatures or similar material.

A signature or record stored or generated through QuickSiteReport does not automatically guarantee legal validity, authenticity, enforceability or evidential status in every jurisdiction, contract or circumstance.

Users remain responsible for determining whether their records satisfy applicable professional, contractual or legal requirements.

14. Accuracy and User Responsibility

Users are responsible for:

  • information they enter;

  • accuracy and completeness of their records;

  • reviewing reports before signing, exporting, submitting or relying on them;

  • protecting access to their device and account;

  • ensuring their use complies with applicable law and contractual obligations;

  • maintaining appropriate copies of important information; and

  • exercising appropriate professional judgment.

QuickSiteReport does not independently verify the factual correctness of information entered by users.

15. Professional Use Disclaimer

QuickSiteReport is a documentation and productivity tool.

It is not engineering, architectural, legal, contractual, health-and-safety or other professional advice.

It does not replace:

  • professional judgment;

  • competent engineering or site supervision;

  • structural or engineering calculations;

  • statutory inspections;

  • contractual procedures;

  • mandatory site records;

  • occupational health-and-safety procedures;

  • emergency procedures; or

  • obligations imposed by applicable law or professional standards.

Users remain responsible for decisions and actions relating to their construction projects.

16. Not a Safety-Critical or Emergency System

QuickSiteReport is not designed as a fail-safe, emergency-response or life-safety system.

Users must not rely solely on QuickSiteReport in circumstances where failure, delayed synchronization, incorrect information or temporary unavailability could directly create an immediate risk of death, personal injury, serious property damage or environmental damage.

Appropriate professional, safety and emergency procedures must always be maintained independently of the Service.

17. Reports and Automated Information

Reports generated through QuickSiteReport are based substantially on information entered or selected by users and other information available to the Service.

Users should review reports before relying on or distributing them.

Where external or automated information is provided, such as weather or similar information, availability and accuracy may depend on third-party services and conditions beyond QuickSiteReport's direct control.

18. Offline Use and Synchronization

QuickSiteReport is designed to support offline use for applicable functionality.

When cloud synchronization is available and enabled, local information may later synchronize with cloud infrastructure and authorized devices.

Successful synchronization may depend on internet availability, authentication, device state, cloud infrastructure, operating-system behaviour, storage availability and successful completion of synchronization operations.

Delays, conflicts, incomplete transfers or synchronization failures may occur.

Users should confirm successful saving or synchronization where particular information is important to their workflow.

19. Data Loss and Backups

QuickSiteReport uses reasonable technical and organizational measures intended to maintain reliability and protect information.

However:

No software application, device, storage system, synchronization mechanism, network or cloud service can guarantee uninterrupted operation or complete protection against accidental data loss.

Data may be lost, corrupted, delayed or become temporarily unavailable due to circumstances including application crashes, device damage or failure, device loss or theft, operating-system failure, storage/database corruption, insufficient device storage, network interruption, synchronization problems, cloud-service outages, authentication failure, third-party service failures, software defects, user actions, accidental deletion or circumstances outside our reasonable control.

Users remain responsible for maintaining independent copies of information that is critical to their business, contractual, legal or professional obligations and should not rely on QuickSiteReport as their sole archival system or sole backup.

Cloud synchronization or backup functionality does not constitute a guarantee that data can never be lost.

Nothing in this section excludes liability that cannot legally be excluded.

20. Third-Party Services

QuickSiteReport may depend on services or infrastructure provided by third parties, including services from Google, Firebase, Google Play, Apple and other operating-system, cloud, hosting, distribution or payment providers.

Some functionality may therefore depend on services not entirely under our control.

Third-party services may experience failures, outages, changes or discontinuation.

Use of those services may also be governed by their own terms and policies.

21. Availability, Maintenance and Software Errors

We aim to provide a reliable Service and take reasonable steps to maintain it.

However, we do not guarantee permanent availability, uninterrupted operation, that QuickSiteReport will always be completely free from defects or errors, permanent compatibility with every device or operating-system version, or availability of every third-party dependency indefinitely.

Maintenance, updates, security fixes or other interruptions may temporarily affect the Service.

22. Software Updates

QuickSiteReport may provide updates to fix defects, improve reliability or security, maintain compatibility, comply with platform requirements, or introduce, modify or remove functionality.

Some updates may become necessary for continued access to online or cloud features.

Users are responsible for maintaining reasonably current supported device and operating-system configurations where required.

23. Acceptable Use

You must not use QuickSiteReport to violate applicable law, intentionally violate another person's rights, distribute unlawful or malicious content, gain unauthorized access to accounts or systems, interfere with QuickSiteReport's operation or security, upload malware or malicious code, fraudulently impersonate another person, intentionally circumvent paid-access or security mechanisms, or deliberately overload, damage or disrupt infrastructure.

24. Intellectual Property

The QuickSiteReport software, branding, design, logos and original materials supplied by QuickSiteReport remain the intellectual property of their respective owner(s) and are protected by applicable law.

These Terms do not transfer ownership of QuickSiteReport intellectual property to users.

User Content remains subject to the rights of the user or other lawful owner.

25. Privacy

QuickSiteReport's processing of personal information is described in the QuickSiteReport Privacy Policy.

The Privacy Policy should be read together with these Terms.

If QuickSiteReport later introduces materially different processing such as new analytics, tracking, location functionality or another service involving personal information, the applicable Privacy Policy and required disclosures will be reviewed and updated before or when required by law.

26. Account Suspension

QuickSiteReport may reasonably restrict or suspend account-based functionality where necessary to protect users or infrastructure, investigate suspected fraud or serious abuse, stop unauthorized access, comply with legal requirements, address material or repeated breaches of these Terms, or protect the security of the Service.

Where legally required and reasonably possible, appropriate notice or opportunity to resolve the issue will be provided.

Paid access will not be arbitrarily removed contrary to mandatory consumer rights.

27. Account and Data Deletion

Account deletion is different from logout, uninstalling the application and cancelling a paid subscription.

Authenticated users may use the account-deletion functionality provided by QuickSiteReport.

QuickSiteReport also provides or intends to provide public account-deletion instructions through its website.

Deleting a QuickSiteReport account does not necessarily cancel a subscription that is independently managed by Google Play, the Apple App Store or another payment platform.

Users should separately cancel active subscriptions through the applicable platform where required.

Additional information concerning deletion and retention is provided in the Privacy Policy and Delete Account & Data page.

28. Disclaimer of Warranties

To the maximum extent permitted by applicable law, QuickSiteReport is provided on an “as available” basis.

We do not guarantee that the Service will always be uninterrupted, always be error-free, meet every possible professional, contractual or regulatory requirement, remain compatible indefinitely with every device or third-party service, or prevent every possible instance of data loss.

Nothing in these Terms excludes mandatory statutory guarantees or rights that cannot legally be excluded.

29. Limitation of Liability

To the maximum extent permitted by applicable law, QuickSiteReport and its operator shall not be liable for indirect, incidental, special or consequential losses resulting from use of or inability to use the Service where those losses are not legally attributable to us or cannot reasonably have been prevented by us.

Subject always to mandatory law, this includes losses associated with loss of business opportunity, loss of anticipated profit, construction delays, reliance on inaccurate user-entered information, failure to independently verify reports, device or network failures, third-party service interruptions, synchronization failures or loss of data where appropriate independent copies or backups were not maintained.

Users remain responsible for their professional decisions, project management, contractual submissions, statutory obligations, construction operations and safety decisions.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer rights or other non-excludable liability.

No arbitrary monetary liability cap is created by these Terms.

30. Responsibility for Misuse

To the extent permitted by applicable law, you are responsible for losses or third-party claims arising directly from your unlawful use of QuickSiteReport, intentional misuse of the Service, deliberate infringement of third-party rights or content that you had no lawful right to provide.

This section does not make a consumer responsible for losses for which that person is not legally responsible.

31. Events Outside Our Reasonable Control

QuickSiteReport will not be considered in breach of these Terms for delay or failure caused by circumstances outside our reasonable control.

These may include natural disasters, fire, war or terrorism, major power failures, telecommunications or internet outages, widespread cloud-service failure, government action, major app-store or operating-system disruption, epidemics or other major emergencies, or other events that could not reasonably have been prevented.

This does not remove rights that cannot lawfully be excluded.

32. Ending Use of QuickSiteReport

You may stop using QuickSiteReport at any time.

The following are separate actions and can have different consequences:

Uninstall App — removes the application subject to the operating system's behaviour.

Logout — ends the current authenticated session but does not constitute account deletion.

Delete Account — starts the QuickSiteReport account/data deletion process.

Cancel Subscription — stops future subscription renewal according to the applicable platform's rules.

Users should take whichever actions are appropriate to their intention.

33. Changes to QuickSiteReport

The Service may evolve over time.

We may reasonably modify functionality, design, limits, supported platforms or technical architecture.

Where a material change negatively affects an active paid service, we will comply with any notification, cancellation, refund or other obligations imposed by applicable law.

34. Changes to These Terms

These Terms may be updated when reasonably necessary because of changes to QuickSiteReport, applicable law, app-store rules, security requirements, payment or subscription arrangements, or our business model.

The “Last updated” date will identify the current version.

We do not assume that every future change can automatically bind users merely because they continue using the application.

If applicable law requires notification or affirmative consent for a material change, the required process will be followed.

35. Governing Law and Consumer Rights

These Terms are governed by the laws of Cyprus, without prejudice to mandatory protections that may apply under the laws of a user's country of residence.

Consumers in the European Union or another jurisdiction with mandatory consumer protections retain any rights that cannot legally be waived or restricted by contract.

Nothing in these Terms prevents a user from exercising a legally available remedy or accessing a competent court, authority or dispute-resolution mechanism.

36. Severability

If a provision of these Terms is found invalid or unenforceable, it will be interpreted, limited or removed only to the extent legally necessary.

The remaining provisions will continue to apply where legally possible.

37. No Waiver

A failure to enforce a provision of these Terms on one occasion does not automatically waive the right to enforce that provision in the future.
